ANTI-CORRUPTION AND WHISTLE-BLOWING POLICY
We expect each of our staff and employees to reflect, through their behavior, SCP Fulgence Law Firm's commitment to scrupulous compliance with anti-corruption rules. Bribery is defined as the act of promising, offering or giving an undue advantage, to oneself or to another person or entity, in order to perform or refrain from performing an act in the exercise of one's duties. This policy applies to all persons working at all levels and scales of the SCP Fulgence Law Firm.
- Objective
The purpose of this policy is to establish standards of behavior that minimize the risk of corruption within SCP Fulgence Law Firm. All persons employed by, working for or on behalf of SCP Fulgence Law Firm are required to comply with this policy. Partners of SCP Fulgence Law Firm are expected to act ethically and may be required to comply with this policy.
SCP Fulgence Law Firm has a zero-tolerance policy on corruption. As follows:
- Staff, including suppliers, must never promise, offer or pay benefits; ;
- Never demand or accept a bribe; ;
- No employee will be retaliated against for refusing to pay or receive bribes, even if such refusal may result in the loss of an opportunity to conclude a deal with a customer; ;
- This policy governs donations and the acceptance of gifts, invitations, entertainment, charitable donations or sponsorships.
- Conflicts of interest
The staff of SCP Fulgence Law Firm must act in such a way as to avoid any conflict of interest:
- Private agreements for the use of discount terms, unless they have been formally negotiated by the firm as a staff benefit and advertised as available to all employees; ;
- Employees may not authorize the payment of firm funds to any outside organization or charity of which they are a shareholder, board member, director or employee.
- Decisions, including appointments and the opening of files, must not be influenced by personal, family or other relationships, or by membership of a religious, social or political association.
- All transactions with private companies, individuals and civil servants must remain clear and transparent, and be carried out correctly and appropriately.
- The gifts
SCP Fulgence Law Firm may offer gifts to third parties, provided that such gifts are reasonable and minor in nature and are intended to maintain or establish cordial relations. However, gifts to third parties must not be offered if their purpose is to influence a particular decision of the third party or to obtain a particular advantage. Gifts must not be accepted if they are excessive, disproportionate or intended to influence a decision or obtain a specific advantage for the third party.
SCP Fulgence Law Firm staff must politely refuse excessive gifts, presents and other benefits, with the exception of conventional hospitality (disinterested acts generally accepted in social relations and included in company practice) and minor gifts below the threshold set by regulations. If SCP Fulgence Law Firm staff have any doubts about the appropriateness of a gift, they should consult their line manager before accepting it.
- Disclosure
SCP Fulgence Law Firm encourages its employees to promptly report any suspected or actual wrongdoing, including violations of the code of ethics and ethical rules of the legal profession. The direct supervisor is the appropriate person to handle any disclosure. Wrongdoing may also be reported directly by third parties to SCP Fulgence Law Firm management, by e-mail or any other means of communication. Any report of wrongdoing received will be investigated further, as appropriate.
- Privacy
SCP Fulgence Law Firm, including all persons designated to receive complaints under this policy, will treat all communications confidentially, in strict accordance with the law and, to the extent possible, taking into account the need for appropriate investigation. The informant will be asked to identify himself or herself, as anonymity may limit SCP Fulgence Law Firm's ability to conduct a thorough investigation. Any complaint filed under this policy must be made in good faith and based on fact or reasonable grounds. Any complaint based on unsubstantiated allegations that cannot be corroborated or are intentionally false or malicious may be considered a slanderous accusation.
- Protection against retaliation
The Fulgence Law Firm protects against retaliation anyone who raises a concern or makes a complaint in good faith about suspected or actual wrongdoing. Retaliation includes all forms of sanctions and adverse employment effects, including termination, suspension, demotion, transfer, harassment and discrimination.
